Employee Gift Policy Company Name: Effective Date: Policy Owner: Approved By: Gift Value Threshold: PURPOSE & SCOPE - This policy establishes guidelines governing the giving, receiving, and reporting of gifts, gratuities, hospitality, and entertainment in the course of business activities. It protects the Organization's integrity and ensures compliance with anti-bribery and anti-corruption laws. - This policy applies to all employees, officers, directors, contractors, and agents acting on behalf of the Organization. It covers gifts exchanged with external parties, including clients, vendors, suppliers, government officials, and business partners. - The Compliance Officer shall serve as the policy owner and shall be responsible for maintaining the gift register, providing guidance on permissibility, and reporting gift activity to the executive leadership team. PERMISSIBLE & PROHIBITED GIFTS - Employees may accept unsolicited gifts of nominal value, not exceeding the threshold specified by the Organization, provided the gift is a customary business courtesy, does not create an obligation, and would not embarrass the Organization if publicly disclosed. - Employees are strictly prohibited from accepting cash or cash equivalents, gifts from parties involved in active tender processes, gifts that could reasonably be perceived as a bribe or inducement, and any gift from a government official without prior approval from the Compliance Officer. - Gifts given by the Organization to external parties shall be approved in advance by the employee's manager and the Compliance Officer, shall not exceed approved value limits, and shall be recorded in the gift register with full details of the recipient, value, and business purpose. HOSPITALITY & ENTERTAINMENT - Business meals and hospitality of reasonable value are generally permissible when they are directly related to a legitimate business purpose, are offered in a professional setting, and are not lavish or excessive relative to the nature of the business relationship. - Attendance at events, conferences, and corporate entertainment funded by external parties shall require prior approval from the employee's manager. The employee shall report the estimated value of the hospitality through the gift register. - Employees shall not use personal funds to circumvent the approval requirements or value thresholds of this policy. All business-related gifts and hospitality shall be processed through official channels regardless of the source of funding. REPORTING & GIFT REGISTER - Employees shall report all gifts received or given with a value exceeding the de minimis threshold through the Organization's gift register within 5 business days. The register shall capture the nature, value, date, parties involved, and business context of each gift. - Employees who are uncertain whether a gift or hospitality is permissible under this policy shall consult the Compliance Officer before accepting or offering the gift. When in doubt, employees should err on the side of declining or reporting. POLICY COMPLIANCE & REVIEW - Violations of this policy, including failure to report gifts, acceptance of prohibited gifts, or falsification of gift register entries, shall result in disciplinary action up to and including termination of employment and may result in criminal prosecution under applicable anti-corruption laws. - This policy shall be reviewed at least once every 12 months by the Compliance Officer in consultation with Legal Counsel. Amendments reflecting changes in anti-corruption legislation or business operations shall be communicated to all employees before the effective date.
