PURPOSE & SCOPE
- This policy defines the conditions under which employees in India may encash accumulated unused leave and the calculation methodology applicable thereto.

ELIGIBILITY & LEAVE TYPES

Everything you need to know

01What Is a Leave Encashment Policy?

A leave encashment policy in India lets employees convert unused earned leave into cash, either during employment or at retirement or resignation. It defines which leave types are encashable, how the payout is calculated, and any caps on accumulation. Rooted in Indian labour laws and shops and establishments acts, the policy gives employees value for leave they did not take while keeping the company's obligations clear and predictable.

02Why Companies Need a Leave Encashment Policy

Encashment is often a statutory entitlement in India, so a clear policy keeps the company compliant with state-specific labour laws and factory or shops and establishments regulations. It also removes ambiguity about calculation and eligibility, reducing disputes at exit. Documenting caps and rates helps finance forecast liabilities, and a fair policy supports retention by ensuring employees are properly compensated for accrued but unused earned leave.

03What a Leave Encashment Policy Should Include

Specify which leave types can be encashed, typically earned or privilege leave, and any accumulation cap. Define the calculation basis, usually basic plus dearness allowance divided by working days, and when encashment is permitted (annually, at retirement, or at separation). Address tax treatment, noting exemptions available to government versus private employees. Align the policy with the applicable state's shops and establishments or factories act requirements.
