Everything you need to know
01What Is a Maternity Leave Policy?
A maternity leave policy explains the time off, pay, and protections available to employees before and after giving birth. It covers leave duration, whether it is paid or unpaid, how it combines with other leave, and job-protection guarantees on return. A clear policy helps expectant employees plan with confidence and ensures the company handles a sensitive, high-stakes life event consistently and lawfully.
02Why Companies Need a Maternity Leave Policy
Maternity leave often intersects with multiple laws covering medical leave, disability, and anti-discrimination, so a documented policy reduces legal risk. It also drives retention, since supportive leave strongly influences whether new parents return. A clear policy removes guesswork for both employees and managers, sets expectations around notice, pay, and phased return, and signals that the organization values its people through major life transitions.
03What a Maternity Leave Policy Should Include
Specify eligibility, leave length, and the mix of paid and unpaid time, including how it stacks with disability or family leave. Explain notice expectations, required documentation, and how benefits continue during leave. Cover job protection and return-to-work arrangements, including any phased or flexible options. Address how accrued PTO interacts with maternity leave, and note pumping or nursing accommodations available once the employee returns.
