Notice Period Policy Company Name: Effective Date: Policy Owner: Approved By: Standard Notice Period: PURPOSE & SCOPE - This policy defines the notice period requirements applicable to the termination of employment by either the employee or the Organization. It establishes uniform standards that ensure orderly transitions, protect business continuity, and comply with applicable employment legislation. - Notice periods serve to provide both the Organization and the departing employee with adequate time to manage the transition, including recruitment of a replacement, completion of pending deliverables, and handover of responsibilities to designated successors. NOTICE PERIOD DURATIONS - The standard notice period for employees at the individual contributor level shall be 30 calendar days. For managerial and senior managerial roles, the notice period shall be 60 calendar days. For director-level positions and above, the notice period shall be 90 calendar days. - The notice period commences on the calendar day immediately following the date on which written notice of resignation or termination is received by the relevant party. The last working day shall be calculated accordingly. - Employees in critical roles or those with access to sensitive information may be subject to an extended notice period as specified in their employment contract. The Organization may also negotiate extended notice periods for key talent retention purposes. NOTICE PERIOD OBLIGATIONS - During the notice period, the employee shall continue to perform their duties diligently, comply with all Organization policies, cooperate fully with knowledge transfer and handover activities, and refrain from any conduct that could damage the Organization's interests. - The Organization shall continue to provide the employee with their regular compensation, benefits, and accrued leave entitlements throughout the notice period. The employee shall remain eligible for any performance-related payments that vest during the notice period. - The employee's manager shall ensure that a comprehensive handover of all ongoing projects, client relationships, documentation, and institutional knowledge is completed before the employee's last working day. WAIVER, SHORTENING & PAYMENT IN LIEU OF NOTICE - The Organization may, at its sole discretion, waive part or all of the notice period and allow the employee to depart before the expiration of the full notice period, with payment in lieu of notice for the unexpired portion. - Where an employee requests early release from the notice period, the Organization may approve the request subject to satisfactory completion of handover obligations. Any unapproved shortfall in the notice period may be recovered from the employee's final settlement. - In cases of summary dismissal for gross misconduct, the Organization may terminate employment immediately without notice or payment in lieu of notice, subject to the findings of a disciplinary investigation and compliance with applicable law. POLICY GOVERNANCE - This policy shall be reviewed at least annually by the HR department in consultation with Legal Counsel. Any amendments shall be communicated to all employees and managers before the effective date. - The HR department shall maintain records of all notice period transactions, including resignation dates, notice period calculations, early release approvals, garden leave arrangements, and payment in lieu of notice authorisations.
