Professional Tax Policy India Company Name: Effective Date: Policy Owner: Approved By: States of Operation: PURPOSE & SCOPE - This policy outlines the Organization's obligations regarding the deduction and remittance of professional tax from employee salaries in Indian states and union territories where professional tax is levied. It ensures compliance with respective state Professional Tax Acts. - The Organization shall obtain a Professional Tax Employer Registration Certificate (PTEC) in every state where it has employees and shall file enrolment certificates (PTRC) as required by respective state laws. DEDUCTION & RATE SLABS - Professional tax shall be deducted from the monthly salary of every eligible employee based on the slab rates prescribed by the respective state government. The maximum annual professional tax liability shall not exceed Rs. 2,500 per employee as mandated by Article 276(2) of the Constitution. - For employees working across multiple states during a pay period, professional tax shall be deducted based on the state in which the employee's primary work location is registered. The Organization shall ensure that no employee is subjected to double deduction. REMITTANCE & FILING - The Organization shall remit the total professional tax collected from employees to the respective state treasury or municipal authority by the due date prescribed under the applicable state Act, typically by the last day of the month following the salary month. EMPLOYEE COMMUNICATION & TAX BENEFIT - Professional tax deducted from employee salaries is eligible for deduction under Section 16(iii) of the Income Tax Act, 1961, and shall be reflected in the employee's Form 16. Employees shall be informed of the monthly deduction through their pay statements. COMPLIANCE & REVIEW - The Organization shall conduct semi-annual internal audits of professional tax compliance across all states of operation. This policy shall be reviewed annually or whenever state governments revise their professional tax rate schedules or filing requirements.
